The basic court process followed in mortgage repossessions is set out below
1. Summons for possession
This is the first stage in the repossession process. The papers are issued by the court and the lender gives full details of their claim A date and time is given for the hearing.
2. The hearing
There are various possible outcomes. If you attend the hearing, the court will often granted a possession order for 56 days (2 months) although this can be longer. If you are still in the property after this time, your lender can get a bailiff’s warrant to evict you.
